A Major Infrastructure contractor wanted advice regarding some unusual terms and conditions implied by a FIDIC standard form of contract in relation to a delayed start date.

 

Our client had already received a legal overview, however the depth of research required meant that it was more cost effective to retain Ormiston James to research and advise on the terms.

 

Over a three week period we were able to explore the multiple options and scenarios available to our client. By producing reports with flow charts our client was well informed regarding the consequences of various decisions according to the contract terms.

A Major M&E Contractor needed  to demonstrate to their client that the project had been delayed, disrupted and prolonged due to Employer risk events. The employer had already deducted damages.

Ormiston James drafted a position statement that was carefully pitched at demonstrating the facts and the entitlement for an extension of time without the need for for a detailed critical path analysis. Our client successfully negotiated the repayment of damages and a final account settlement.

A major project using the NEC form of contract with an inflexible completion date was seriously affected by a structural design delay. The main contractor wanted to deliver the project on time.

 

Ormiston James drafted a projected delay analysis along with an acceleration proposal. The matter was successfully resolved in mediation and the project completed on time.
